In a groundbreaking decision that reverberates across Latin America, Mexico’s Supreme Court has officially decriminalized abortion, taking a significant stride toward expanding reproductive rights. The ruling, which has set a precedent for the region, deems the federal laws prohibiting abortion unconstitutional, citing a violation of women’s rights. This historic judgment follows in the footsteps of the “green wave” movement, a growing trend across Latin America advocating for wider access to abortion services.

The Supreme Court’s verdict mandates the removal of abortion from the federal penal code, compelling federal health institutions to offer abortion services to anyone who requests them. The Information Group for Chosen Reproduction (GIRE) welcomed the decision, emphasizing that no woman or health worker will face punishment for seeking or providing abortions.

Although this ruling is a monumental leap forward, approximately 20 Mexican states continue to criminalize abortion. While judges in these states will be obliged to adhere to the Supreme Court’s decision, further legal efforts are necessary to eliminate all penalties for abortion.

The public response to the decision was swift and diverse. Supporters took to social media to celebrate the victory for women’s rights, hailing it as a significant step toward gender equality. Senator Olga Sánchez Cordero, a former Supreme Court justice, commended the decision and urged Mexico’s Congress to enact legislation in response.

However, opponents, driven by deeply held religious beliefs, expressed their discontent with the ruling. Irma Barrientos, director of the Civil Association for the Rights of the Conceived, vowed to continue the fight against expanded abortion access, drawing parallels to the United States’ long-standing debate over abortion.

The Supreme Court’s decision builds on a 2021 ruling that declared abortion legal in one northern Mexican state, initiating a gradual state-by-state process of decriminalization. Last week, Aguascalientes became the 12th state to drop criminal penalties for abortion.

While the ruling does not guarantee immediate access to abortion for all Mexican women, it compels federal agencies to provide care, potentially removing obstacles for patients seeking abortions in states where it remains criminalized.

Nevertheless, concerns linger, particularly for women in conservative areas who may still face denials. Women’s rights advocates stress the importance of closely monitoring how the decision is implemented and its reach.

Mexico’s decision to decriminalize abortion aligns with a broader trend across Latin America, often referred to as the “green wave”. This movement, symbolized by green bandanas, represents the growing call for reproductive rights across the region.

In contrast, the United States has seen increased abortion restrictions in several states. Many American women have turned to Mexican abortion rights activists to obtain abortion pills, highlighting the sharp divergence in abortion policies between the two nations.

The U.S. Supreme Court’s overturning of Roe v. Wade in 2022 has left the fate of abortion rights in the hands of individual states, further dividing the nation politically.

As the implications of Mexico’s Supreme Court ruling unfold, it is clear that the journey toward comprehensive reproductive rights continues. Challenges and resistance may persist in conservative regions, reminding us of the ongoing struggle to secure these fundamental rights for all women and individuals capable of gestating.
